Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the SweepShark website, platform, and all associated services (collectively, the “Platform”). By registering an account or otherwise accessing the Platform, you agree to be bound by these Terms in full. If you do not agree, you must not use the Platform.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to register or participate. The Platform is void where prohibited by applicable law. By creating an account you represent and warrant that you meet all eligibility requirements. We reserve the right to request proof of age at any time and to suspend or terminate accounts that cannot satisfy such a request.

Residents of certain states or territories may be ineligible to participate in sweepstakes redemption features due to local law. It is your responsibility to determine whether participation is lawful in your jurisdiction before registering.

2. No Purchase Necessary

No purchase, payment, or financial contribution of any kind is necessary to enter, play, or win on the Platform. Gold Coins and Sweeps Coins may be obtained free of charge through promotional methods described on the Platform. Making a purchase does not improve your odds of winning. Void where prohibited.

3. Virtual Currency — Gold Coins and Sweeps Coins

Gold Coins are a virtual play-only currency. Gold Coins have no cash value, cannot be redeemed for prizes, and are provided solely for entertainment purposes.

Sweeps Coins are a promotional virtual currency that may be redeemed for prizes (including cash prizes) where permitted by applicable law, subject to the redemption conditions published on the Platform. Sweeps Coins are not property, have no cash value prior to confirmed redemption, and are non-transferable except as expressly permitted by SweepShark. SweepShark grants you a limited, revocable, non-exclusive license to use Sweeps Coins within the Platform solely in accordance with these Terms.

Neither Gold Coins nor Sweeps Coins constitute gambling chips, tokens of value, or real money. No language in these Terms or on the Platform should be construed as an offer to engage in real-money gambling.

4. Account Registration and Security

You may maintain only one account. Creating multiple accounts is prohibited and may result in immediate termination of all associated accounts and forfeiture of any accumulated virtual currency. You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify SweepShark immediately if you suspect unauthorized access to your account. SweepShark is not liable for losses caused by unauthorized access resulting from your failure to safeguard your credentials.

5. Fraud and Abuse

Any attempt to exploit technical vulnerabilities, use bots, scripts, or automated tools, create fraudulent accounts, manipulate sweepstakes outcomes, or otherwise circumvent the rules of the Platform is strictly prohibited. SweepShark reserves the right to investigate suspected abuse and to void entries, forfeit virtual currency, suspend or permanently ban accounts, and pursue legal remedies to the fullest extent permitted by law.

6. Intellectual Property

All content on the Platform — including but not limited to software, graphics, logos, game designs, text, and audio-visual elements — is the exclusive property of SweepShark or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any Platform content without prior written authorization from SweepShark.

7. System Outages and Technical Issues

SweepShark does not guarantee uninterrupted or error-free operation of the Platform. Scheduled maintenance, unplanned outages, or third-party service failures may temporarily interrupt access. SweepShark will make commercially reasonable efforts to restore service but accepts no liability for losses, missed play opportunities, or forfeited virtual currency resulting from system interruptions beyond its reasonable control.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SweepShark, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages — including loss of profits, data, goodwill, or opportunity — arising from or related to your use of or inability to use the Platform, even if SweepShark has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, SweepShark’s liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless SweepShark and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

10. Termination

SweepShark may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to a breach of these Terms, suspected fraud, or inactivity. Upon termination, your license to use the Platform immediately ceases and any accumulated virtual currency is forfeited. Provisions of these Terms that by their nature should survive termination — including Sections 6, 8, 9, 11, and 12 — shall survive.

11. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally shall be submitted to binding individual arbitration, rather than resolved in court. You waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitration shall be conducted on a confidential basis and the arbitrator’s decision shall be final and binding.

Class-Action Waiver: You and SweepShark agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

12. Governing Framework

These Terms shall be interpreted and governed in a manner consistent with applicable sweepstakes law and the principle that no purchase or payment is required to participate. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

SweepShark reserves the right to update or modify these Terms at any time. When changes are made, the revised Terms will be posted on the Platform with an updated effective date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
